Sorin Grindeanu’s Petition Postponed by CCR

The Constitutional Court of Romania announced today the postponement of the resolution of a constitutional legal conflict between the Romanian Parliament and Government. The conflict, brought to the Court by the President of the Chamber of Deputies, Sorin Grindeanu, is related to Emergency Ordinance No. 38/2026 concerning the European SAFE rearmament program.

Sorin Grindeanu, also the leader of PSD, filed the petition in his role as Speaker of the Chamber of Deputies. The core issue revolves around the claim that the Ilie Bolojan government, despite being ousted by a no-confidence vote, overstepped its authority by issuing a substantive legislative emergency ordinance.

Grindeanu argues that a dismissed government should only handle day-to-day affairs and not legislate through emergency ordinances. The petition alleges that the executive branch interfered with ongoing legislative processes in Parliament, breaching the principle of constitutional loyalty.

The complaint emphasizes that a government lacking political support and legitimacy, as in this case, should not enact laws with significant strategic implications like the SAFE rearmament program. Grindeanu urged the Constitutional Court to establish clear boundaries for the functions of a dismissed government to avoid setting a dangerous precedent.
